Parks are protected in New York State for the use of people as open space. A City in the State cannot decide to simply close down a park and use the land for something else without getting approval from the state government after land has been dedicated as parkland.
In order to convey parkland to a nonpublic entity, or to use parkland for another purpose, a municipality must receive prior authorization from the State in the form of legislation enacted by the New York State Legislature and approved by the Governor. “Once land has been dedicated to use as a park, it cannot be diverted for uses other than recreation, in whole or in part, temporarily or permanently, even for another public purpose, without legislative approval.” United States v. City of New York, 96 F.Supp.2d 195, 202 (E.D.N.Y. 2000). This clear law has been applied consistently since 1871.
The question is: what is parkland?
The term “dedicated” is often used in referring to municipal parkland subject to State alienation requirements. Common phrases include “lands dedicated for park purposes” and “dedicated parklands.” The dedication of parkland may be formal through an official act by the governing body of the municipality.
Dedication can also be implied. This may occur through actions which demonstrate that the government considers the land to be parkland or the public used it as a park. Examples include: a municipality publicly announcing its intention to purchase the lands specifically for use as a park, “master planning” for recreational purposes, budgeting for park purposes, or “mapping” lands as parkland. Kenny v. Board of Trustees of Village of Garden City, 735 N.Y.S.2d 606, 607 (App. Div. 2nd 2001)(property acquired for recreational purposes and used for recreation was instilled with public trust even though never officially dedicated).

On March 11th, 2017 from 2pm-5pm we held our 3rd community meeting for the Essential Garden of South Jamaica which was a success. We are excited and ready to convert this abandoned space for public access! Let's Get It!!


Although the weather storm on Saturday slowed many of us down, the EGSJ Community Leadership Meeting on January 7th, 2017 from 2pm-5pm at Southern Girls Soul Food Restaurant was a success! Our bylaws have been executed by our community leaders! We would like to welcome the below leaders elected and voted into their positions for the HipHoticHelps Essential Garden of South Jamaica.

Please include the full name, email, and contact number for the candidate. The Vitamin, Minerals, and Herb Group Leadership positions require knowledge and experience with growing 100% natural foods and yielding large crops in New York City climates. Teaching experience is not necessary, but is a HUGE plus. Knowledge of indoor pyramid growing is required for our Essential Herb leadership. We appreciate your continued support working together towards bringing this vision into fruition for our community. Thank you.
Trish Van Buren, founder of HipHoticHelps held a meeting with Councilman, Ruben Wells on 12/21 at 4:15 pm-5pm. Ruben Wells office will show support for this project by requesting NYC Parks clean up the lot, remove dead trees, dying trees, tree stumps, and overgrown land. We are approaching warm days and suggest clean up can take place then. We are hoping he can make this happen for the community.


There was an overwhelming amount of feedback about the suggested inductees to highly anticipated Historical Mural inside the HipHoticHelps Essential Garden. Our community membership has grown with 10 more members in 24 hours. We appreciate the support to make this project a success.
HipHoticHelps is a community organization and does not endorse any politicians or take any political views. Due to the concerns expressed from the community, HipHoticHelps will not be inducting Donald Trump or Mario Cuomo on the mural. Thank you.
I lived in SJ Queens all my life, and the Hilton didn't do much to this space. I am eager to see what Hiphotichelps can do with this property. I will email to see how I can help your organization. I do not have a green thumb but I can build things and clean up.
